Supreme Court of India ने हाल ही में digital evidence के बढ़ते इस्तेमाल और criminal investigation standards पर महत्वपूर्ण observations देते हुए कहा है कि technology के इस दौर में electronic records, CCTV footage, call data records, और device-based evidence की handling और verification के लिए uniform, strict और transparent procedures होना बहुत ज़रूरी है। Court ने यह भी कहा कि अगर digital evidence की chain of custody और authenticity properly establish नहीं की गई, तो इससे trial की fairness पर गंभीर सवाल खड़े हो सकते हैं।
Court के अनुसार, आज की investigations में smartphones, servers और cloud data की भूमिका बढ़ गई है, लेकिन कई मामलों में forensic extraction, storage और presentation के standards अलग-अलग agencies में अलग पाए जाते हैं। इससे tampering, selective use या misinterpretation का risk पैदा होता है। Bench ने जोर दिया कि investigating agencies को standard operating procedures (SOPs) अपनाने चाहिए, ताकि evidence collection से लेकर court presentation तक की पूरी प्रक्रिया reliable और auditable हो।
Judges ने यह भी कहा कि judiciary और police दोनों को technology training की जरूरत है, ताकि judges evidence की technical nature को समझ सकें और investigators सही तरीके से उसे collect और preserve कर सकें। Court ने संकेत दिया कि भविष्य में guidelines या broader framework तैयार किया जा सकता है, जिससे पूरे देश में एक consistent digital evidence regime लागू हो सके।
Legal experts का मानना है कि यह observation आने वाले समय में criminal trials की quality और credibility को मजबूत कर सकता है, खासकर ऐसे दौर में जब crimes और communications दोनों तेजी से digital होते जा रहे हैं।
